Usage rights and limitations on use - Artificial Intelligence

Regarding Artificial Intelligence license agreement between SpringerNature and Eira includes the following terms:

 

Prohibited Uses

Neither Licensee nor Authorized Users shall: 


except as permitted by applicable law or this License Agreement, update, change, revise, adapt, modify, translate, transform or create any derivative work of the Content, for clarity, such prohibition extends to doing any of the foregoing with the use of artificial intelligence (AI) tools.

Neither Licensee nor Authorized Users may use the Content to train, directly or indirectly, any AI tool or system.

Artificial Intelligence (“AI”) refers to the branch of computer science that is designed to mimic human cognitive functions such as learning, reasoning, problem-solving, understanding natural language, recognizing patterns, and making decisions.

Direct training involves the intentional incorporation of Content into the training dataset of the AI tool or system, whereas indirect training occurs when the AI tool or system learns from Content provided to it for other purposes.

The parties further agree to monitor legal and technological developments in relation to AI, and may address questions related to interpretation of the foregoing in an FAQ document, and if needed, mutually agree to changes to the foregoing in the future.

A first version of the FAQ document as agreed by SpringerNature and Eira will be published here in the first quarter of 2024.
